Not at all. If you run a red light and kill someone, but the death is attributed to their lack of wearing a seatbelt, you wont face manslaughter. There have been many cases that follow this same path

if he hadn't ran the cop would be alive, it should be a murder charge.

Look at the Donte Stallworth case. Most legal experts believe he would have beat the manslaughter charges had he went to trial, even though he was proven to be driving drunk.

Read it. If it doesnt make sense to you I cant help you. I am currently looking up cases where people beat manslaughter charges due to the victims lack of seatbelt

An officer

1. initiates a stop.
2. chases suspect without his seatbelt
3. apparently just lost control of his car as it "veered" meaning he may have been driving just as reckless

Cop dies because he wasn't wearing seatbelt = someone else's fault

Another cop
1. Illegally enters the wrong home in a no-knock warrant
2. Inappropriately fires into a poorly lit room while the homeowner defends his property
3. Blows a little girl's head off

Innocent kid dies = innocent homeowners fault for daring to legally protect his own property

I see how this works.

I;m generally well onto the side of the cops on these issues, but I can't see this charge.

The police are trained to know when to chase, how to chase and when to cut off a chase if it gets too dangerous.

His death is 100% on himself.

Seatbelts don't make you invincible.

If he was wearing his seatbelt and still died this guy would probably be charged with vehicular homicide.

I am looking up drunk drivers/ running red lights. To get a specific case exactly like this seems impossible

it's costly to engage in high speed pursuits and more police departments should stop allowing this behavior

I understand that the manslaughter charge is within the letter of the law.

I'm commenting on the spirit of the law, so to speak.

Honest question - if a cop is speeding down I-10 in order to get behind someone and pull them over, and he ends up in an accident that cost him his life, does the speeder get manslaughter charges?
