Manslaughter is an overreach.

§31. Manslaughter
A. Manslaughter is:
(2) A homicide committed, without any intent to cause death or great bodily harm.
(a) When the offender is engaged in the perpetration or attempted perpetration of any felony not enumerated in Article 30 or 30.1, or of any intentional misdemeanor directly affecting the person; OR
(b) When the offender is resisting lawful arrest by means, or in a manner, not inherently dangerous, and the circumstances are such that the killing would not be murder under Article 30 or 30.1

you also have to consider the possibility that he wasnt buckled up because he had stopped them and got out of the car to speak to them and then they took off (this happens alot)
and when he got back in his car he forgot to put his seat belt back on
i dont know the facts of the case, just saying that its possible

Eh, in a civil trial, the officer would most likely have some comparative fault.
Forgive my ignorance, but what would a civil trial have to do with the criminal trial?

Maybe you're just insecure?

While unfortunate, this situation reflects the prevailing lack of accountability in government--in this case law enforcement. I mean we are inundated with "click it or ticket" ads on TV, billboards, and the radio. It is a behavior taught to pre-k age students and younger, yet when the officer fails to follow a behavior children are capable of--while dangerously pursuing a criminal (who shouldn't have ran)--the blame is completly taken away.
The suspect deserves punishment for his crimes, but when the officer fails to use basic, child-level common-sense, and breaks the law as well, then the officer deserves blame for his stupid and irresponsible actions.

The cop's death is a direct result of these guys' decision to run.
I would say it's more of an indirect result.
His death is a direct result of his inability to maintain control of his vehicle and not wearing a seat belt.

So what if seatbelt not buckled.
The law on manslaughter is very clear. He was killed in pursuit of felon. The a-hole thug that ran deserves to get locked up for the officers death.

quote:So just a hypothetical since you seem 100% on how clear the law is. What if the officer was drunk? High? etc. Is there absolutely nothing in your eyes that changes anything?

I am not in anyway saying that happened here

quote:Walk into an elementary classroom, and ask students why they should wear a seatbelt, and you will get told it keeps you safe in a car accident. If children know this, then an officer, who enforces--and apparently breaks--seatbelt laws, has no excuse for such irresponsible behavior. Add the fact that he didn't think of this basic behavior while on a high speed chase, is astonishingly stupid.
