How do the courts decide what date to ANNOUNCE IF THEY WILL/WILL NOT indict?

I am talking about the STERLING case only. Anybody know? Not sure if this is for the Political Talk board.

An indictment is handed down by the grand jury. Basically. The evidence is heard by them against the person and they decide if there is enough to go to trial against that person with what they have.

They aint indicting shite. It was a good shoot. Guy shouldn't have resisted, and was actually armed with a weapon as a convicted felon. Enough video footage to rule out cops tampering with the evidence. Sterling got what Sterling asked for by simply not putting his hands behind his back.

They don't have to take it to grand jury.

The US attorney and/or DAs can choose to not take it to take it to the grand jury and choose not to prosecute.

Depends on the jurisdiction, but most Grand Juries only meet on certain days during a given period. In this matter, the Federal Gov't (DoJ) is investigating. I'm not sure if they will make a recommendation to the East BR DA's Office or if they will present evidence to a Federal Grand Jury in Baton Rouge.

Either way, it will be a thorough and likely lengthly investigation.

I'm not up to speed on my Louisiana Code of Criminal Procedure, but murder might have to be indicited by a Grand Jury, vs a DA simply filling out a True Bill of information to charge.

If Federal, it must be ran through a Federal Grand Jury.



Question - If indicted and charged with murder, what is the BRPD's policy on defending an officer? Is it up to officer on their own personal behalf to retain and pay for a criminal defense attorney or does the BRPD pick up the bill? I would guess since the action is found to be out of the line of scope of the job that it is up to the cop personally.

My mom was on a grand jury about a year ago and they indicted in about 98% of the cases presented.

Considering the feds are involved and the DA has recused his office it will probably take a couple of months before it gets to a grand jury. I would bet the stars will align and the (state) grand jury will come back with no indictment right before the first LSU home football game.

If they get an indictment, they will announce it when it happens.

Normally if they don't indict, they won't say anything, but they may say something here due to the publicity of the case.

And it's not "the courts" it's "the prosecutor"

If they don't indict, they announce at 4:55 pm before a holiday weekend and hope nobody notices.

I seriously doubt there is any way this does not go to a grand jury, it is possibly but not likely. The grand jury is the ultimate way to pass the buck.
