house/act of closing question

Can I refuse to extend to the closing date on a house and any new paperwork that comes in? I have been dealing with a dumbass buyer for almost 3 months (since mid june)

I am tired of her never ending list of demands and BS. We accepted her low offer because we wanted this to get over with fast. But all she done is drag her heels. Its nott like she can sue me because my money is well hidden in a variety of places)


The background story. (potential TL;DR trigger warning, lol)

Yes. I know, holy wall of text. I inherited a house and put it on the market in early July. It was appraised at a good price. In the first week, someone offered a price about %20 under the selling price and we agreed so we could get this over with quick. She also gave a take of woe, etc and we felt bad for her.

The act of closing was to be held Aug 15. That day came and went and she is still doing nothing. She also expects us to hire a spanish interpreter at out cost to have for our negotiations. We refused to pay for that.

Then she said there was an obstruction in the sewage line. It still is completely functional but something keeps the camera from going thru. We paid to have it inspected twice and told her the cost would be paid for us.

She wants us to pay the most expensive price (7500 - professional plumber) in cash and give the cash to her. ( her pro plumber said he could fix it for $1000 or less).

She also now want to extend the act of close till late next month and I refuse to sign the papers. I will NOT give her another month when she has already wasted 2 months of our time.

At this point I am no longer interested in selling her the house. She has done nothing bitch and complain. My sis is in agreement and we own half the house (with 2 other relatives). We can just put on the market and make about 10's of thousand more on the deal with no hassle.

Can she try to sue us for something if we refuse to sign?

You can back away from the sale as long as she violates something agreed to. Lucky for you there is no escrow tied that you would lose if you back out

I'd say frick her and back out of the deal. Keep the house and sell it for 20% more

If you are using the standard purchase agreement in Lousiana, the Act of Sale clause covers this in fairly good detail. IF the buyer is holding up the closing, and you will miss the Act of Sale date, you certainly are not required to sign an extension.

See a lawyer. The question cannot be answered properly until a review of the contract and all contingencies.

Ok, man, I'm sorry for your troubles and I'm not normally one to complain about this but...

Did you try to read your own post? It's bad man... Real bad.



Advise: Get a lawyer. This is probably more than you want/can deal with if you're trying to back out.

The contract she put in on the house should specify the damages for backing out before closing, right? It can vary. She certainly can't sue you for anything. It's still your house. You can back out. But there will be a fee of some sort.

There are several details missing in order to provide proper advice....ie entire purchase agreement, inspection Repair Request, etc.

You can refuse the extension, but probably can't back out. They will then say the house isn't fit for purchase (or something like that) and back out.

$7500 for plumbing work? Is she wanting to replace the whole system? I'd tell her to f off, in Spanish!

I'd call off the deal.

I just bought a house in April. It's a confusing mess, so don't take my word as gospel, but I would assume if she asks for an extension on the closing date yet you say no then that means the contract is void if she's not ready by the closing date.

Secondly, she can ask you to fix whatever she wants, but you're not obligated to fix anything. If you don't fix those things, then she can pay for it herself or back out at no cost to her. I sure don't see how she can dictate "who" fixes what in your house.

This is not something you can get answered here. Go see a lawyer and bring any documents you have relating to this potential sale.

If the closing date on the contract has passed you can back out. You are under no obligation to sign an extension.

She is definitely holding up that closing date. In June and SHE set the date that was set for August. Shes known of the minor sewage issue for MONTHS and when she did so she demanded a check for $7500. And for us to pay her closing costs and fees.
