Provided the student meets the age of consent and it was consensual between them both, he should only be fired and his teaching license revoked. There's no reason to put him in jail if above conditions are met.

What if he was a teacher at the school, but not her teacher? I just don't understand how this can be illegal. Fire him yeah, but there's no merit to arrest him

Other than the fact that a law was broken

Not saying he should be jailed, but he did break a law, so it should be enforced.

Yes you can be 2 years older than a 17 year old. You just can't be a teacher. That 2 year rule applies only when both parties are under 17.

I understand the idea that the "child" is well old enough to know what they are doing at 17, but laws like this have some logical basis.

Can you see how teachers who have access to our children more hours of the day than parents do, that also control a good portion of their value and future (via grades) could take advantage of that leverage? That's why these laws were created.

It isn't just teachers who fall under this category of authority positions. For example, a school guidance counselor could take that information from the student to influence the student into sexual activity.

Kids are impressionable man. I don't know if he should do time but he was in a position of authority so it's worth an investigation. Definitely should lose career as an educator.

And it's another dumb law that represents overcriminalization of everything. This guy has a good chance of being put on the sex offender registry, he'll be out in 5-8 years and we will wind up having to support him with our tax dollars when he can't find a job after that because it will follow him everywhere and no one wants to hire him. He'll likely turn to actual crime that actually victimizes people.

It's such a self destructive cycle and we really need to ruining non violent offenders out of a misplaced sense of justice. The power of labeling literally ruins people.
