Getting a speeding ticket but didn't sign it

A friend got an out of state speeding ticket for going 70 in a 45. After he gets home and looks at it, he notices at the bottom that it reads:

My signature signifies that I have received a copy of this violation notice. It is not an admission of guilt. I promise to appear for the hearing at the time and place instructed or pay the total collateral due.

The officer never asked for his signature when he was handed the ticket so the signature line is blank.

On the back of the ticket there is a section that reads:

NOTICE
If you fail to pay the amount due or to appear in court on the date and time scheduled, the United States District Court may issue a summons ordering you to appear or issue a warrant for your arrest. If you are charged with a motor vehicle violation, the court may also report your failure to pay or appear to your state's motor-vehicle or driver-licensing agency, which may affect your driving privileges, or your vehicle registration, or both.


Ticket is $350.

Should he just pay it or fight it?

Your buddy will probably still get jammed up if he fails to pay it.

Sounds like he deserves it, regardless if it was signed or not

He got a ticket on federal property. This is not a ticket he wants to play around with.

The signature is just proof of service

Your buddy could potentially not go to court and argue he never had proof of service as he didnt sign it, but then again the prosecutor could just put both the officer and your buddy (after then subpoenaing him at home) on the stand under the oath

the officer would testify that he did give the citation to your buddy but yes he forgot to make sure he signed it

your buddy could get on the stand and perjure himself

the facts of the traffic stop would not change just because your buddy didnt sign the ticket so thats not proof positive that he didnt commit whatever violation he was cited for, so he could still be found guilty of the speeding charge


i'd just go ahead and show up or pay it

No, just the officer's printed name is on there. No place for an officer's signature.

Any dashcam involved? Personal recording device on the cop? Oh, your "friend" doesn't know if he was on camera or not ya say. Yeah, no worries, out of state, out of mind. No way at all this could bite "him" in the arse.

As has been explained, the signature is just proof of service. He could be subpoened to show, and all the cop has to say is that "Yes, I did give him this ticket".

So he would have to go to court out of state, and end up paying way more in court costs.

Plus this sounds like it was on Federal property. Do NOT frick with that.
