Fair Labor Standards Act: Mandatory overtime for anyone making less than $47,476

The Department of Labor has expanded the rules under The Fair Labor Standards Act (FLSA) for employers regarding paying employees for overtime. The DOL has increased the overtime rules exemption for employers effective December 1, 2016. The long awaited rules require employers to pay overtime (hours beyond 40 per week) to all employees making less than $47,476 per year.

How are employers affected?

If your company is already paying employees on an hourly basis..........no changes.

If your company is paying employees a flat salary (exempt) of over $47,476 per year.......no changes.

If your company is paying any employee a flat annual salary of less than $47,476 per year then overtime is required for anyone working over 40 hours a week.

THANKS OBAMA! Can't wait to start firing employees to offset the cost increases

I would imagine companies will let go people making $30-35k or reduce their hours to part-time work, give raises to those making around $44k to over the $47k threshold and give them more work.

Another plan by government to "help" its citizens that will only end up hurting them in the long-run.

What this really means is that employees will no longer have the option to trade overtime pay for extra paid time off.

Yup. They may be salary but they will be punching a clock. Need to take a couple hours to run an errand, go to the doctor, pick up your kids, etc... You will have to use that vacation time.

How will being forced to pay employees more for jobs they are currently doing create more jobs?

Just don't allow people to work over 40 hours a week but make them do the same amount of work. It will cut out a lot of inefficiency.

Yeah, this was totally needed, it's not like the billions spent litigating FLSA claims over the last decade was sufficient.

DOL is a shitty, shitty, shitty entity.

This will also move a lot of employees off of salary and onto the hourly basis. The employees will probably have their job hours cut back 15 to 20% so they don't reach OT forcing employers to hire more PT employees.

End result is that PT employees aren't eligible for mandatory insurance requirements. Push a balloon in the middle and air moves to the outside and that's exactly what this will do.

This has been an interesting topic for postdocs. We're poorly underpaid and overworked, but "doing it for the experience". Of course I welcome a small bump in pay, though. I saw the e-mail to our admin and it's more than what the quote says, it's over a 10k increase to my boss when benefits are added.

Just pay them hourly or limit their hours.

You can still pay someone $25,000/yr, you just have to pay them OT if they work OT.

I don't see the horror in paying someone for time they work.

Because it's the government's way of eliminating the idea of salaried employment based on wage rather than position?

This is the Obama WH and runaway agency power (DOL) telling citizens and companies that they're not allowed to contract with each other to do a year's work at the salary of 47k.

It's stupid and unneeded social engineering which will do nothing to help the economy.
