They can/will still charge you with DUI for blowing under a .08 BAC even if you do agree to blow.

So that's the reason people that live in a certain geographic area get to drive drunk around town? Please explain this to me.

Checkpoints are placed in areas where people have enough disposable income to spend at bars while still being able to afford a vehicle.

True, you may get arrested. But not convicted. I agree with you in that I'm against checkpoints. But, if someone is drunk and swerving all over the road, I hope they get pulled over and arrested. I would think you would agree. If someone has a few and is able to drive straight, great.

Now if you are sober, drop your cell phone under the seat and while retrieving it you swerve and get pulled over, you have a decision to make. If he asks you to blow, and you feel it's a violation of your rights, then you will suffer the consequences of losing your license. That's on you.

I agree. It can at times be a difficult balancing act for me. On the one hand I obviously do not want drunk drivers on the road, but on the other hand I do not want essential constitutional protections stripped away. At the end of the day, I think courts side with check points purely on a public policy basis, which I get. However, I just have a real problem with the self incrimination part. That's fricking essential to the American legal system.

So they have nothing to do with preventing drunk driving and everything to do with fines?

I notice they always do them either around LSU, downtown, and Perkins.

BINGO! Checkpoints have always been a money grab. Just look at all the fees required to go thru to whole DWI mill process. Not condoning drunk driving, mind you, but you don't see this level of fees for any other crimes, theft, robbery, etc.
