So back in September this lady backed into me in a parking lot. She gave me her info and left the scene b/c she didn't have time to wait on the cop. I didn't give her any of my info and we agreed she was at fault but now her insurance is trying to get half her damages covered by my insurance. The cop at the scene asked me if I wanted to press charges for a hit and run but I told him I didn't think that was necessary as long as it was clear she was at fault; that was my mistake. I'm thinking now I either want to press charges or at least threaten to, to make this claim go away. Can i do that at this point or is there a better course of action to take?

I had a guy back into me at a Popeyes. I called the police, but they said it was private property and couldn't ticket him. He had a rental car, and out of state license.

I just paid out of pocket to get the paint buffed and the dent pulled.

It's not the lady's fault her insurance is doing that. Insurance companies only profit by paying out the least amount possible.

No paperwork proving she was at fault.

Though to flip it. I hit a Jaguar back in 2010, I was crossing three lanes of traffic and he didn't yield to me. Guy was in a rush and took a pic of my Insurance ID card, no pic of license or anything.

My insurance gave him $6,000. There was just a small dent in the door and a paint scrape.
No one called me for info or anything.

A truck scuffed down my driver's side because it pulled in too close. He left a note with his name and number on my windshield (because someone who knew who he was saw him hit my car, and he knew it). I got an accident report and sent a copy to his insurance company when I got in contact with them. Because of the report they paid for every single bit of the repairs even though he refused to return their phone calls to his residence.

So physically hold her against her will? Do you know what kind of charges that would bring?

More like let her leave, call the cops.

"Hey cops, bitch left."

Profit.

you sound super beta for letting her leave the scene.

Yeah, the alpha thing to do would've been to hold her there at gunpoint.

Police do not assign fault. They only report what happened.

disagree, whoever gets the ticket is at fault.

you know when you are coming out of a business to a three lane street and there is an opening and one car waves yo through so you inch forward?

I got to two lanes, the guy saw me, and had a red light, yet pulled up fast and I clipped him.

I get I was at fault, but he could have stopped rather than try to cut me off.

Come to find he was just in a hurry.

Wrong

Police give tickets because violations occurred.

But in the end, it is insurance companies that agree at who is at fault. If they cannot agree then the court system determines fault.

Most times, police ticket who they believe is at fault, but that is only their opinion and is not official.

But wouldn't it be great fun for all lawsuits to simply be decided by what a cop thinks? No appeal, doesn't matter the evidence, just a single cop and his opinion. Lulz
