If this happened in Alabama you have zero chance of getting to court much less winning. This al.com article explains it pretty well. LINK

It's ridiculous how well doctors/insurance lobbyists have swayed public opinion. Anyone who sues a doctor is a scumbag to these idiots.

So because my opinion is different than yours, I'm an idiot?

That weight was from swelling due to fluid retention. My kidneys were shut down and I basically was carrying aground 7+ gallons of excess fluid.

You should not be on a message board asking for legal advice, but since you are here goes. I do not know what state you reside in, but each state has variations of limitations of liability for medical malpractice. However, from what you've described and speaking as one familiar with the defense of medical malpractice claims, I would urge you to consult an attorney in your area. You can get a referral by going to a website of your state's version of a trial lawyers' association or state or local bar association. It is certainly worth a consultation, for which you are very unlikely to be charged. Good luck.

There is likely some liability on the PCP for failing to send you to the cardiologist sooner, but proving that it changed the outcome of your case will be more expensive to prosecute than your potential recovery. I think you're in Huntsville as well which would make a Med Mal verdict nearly impossible to obtain. Your venue is terrible for verdicts

Speaking as a doctor, I'm wondering if there's more to the story bc from your symptoms it sounds like CHF should've been in the differential immediately. Classic findings.

This is my thought as well.

Not calling you a liar, however the disease course and symptoms as you described them are an extremely classic straightforward chf presentation.

I have a very hard time believing all 3 doctors missed that, and that asthma or pneumonia never existed.

Medicine isn't a n exact science. They did not maliciously mis diagnose you.

Aren't you in northeast Alabama? I'd try to find a lawyer in Huntsville, Birmingham or even Atlanta who specializes in medical malpractice. I don't know whether you have a case or not, but it's worth looking into.

Steroids can cause swelling/fluid retention and, rightly or wrongly, you had been previously diagnosed with pneumonia when you hit the ER. Maybe you don't have a case against the ER doc or either of the GPs, but I think you are correct in investigating the possibility.

Everything has already come back up to normal except my kidneys. They've got better but are still not normal. This is causing me to have issues with fluid retention. I'm on lasics (I've lost 55 lbs since surgery from shedding 7+ Gallons of fluids). But I'm still dealing with fluid issues. For example I'm scheduled to go Friday to the hospital and have fluid drained from around one lung and will turn around Monday and have the same procedure done for the other lung.

It's your heart failure causing the fluid retention and the pleural effusion, not your renal function.

An attorney will look at your story and be able to tell you if you have a case with just a phone call. I had the same surgery exactly 1 year ago and I'm only 36. I happened to be seeing my doctor for something else and she heard a murmur and that's how everything got started. I would think you would have had a murmur if you were to the point of heart failure.

You won't win that case, but you are smarter/ wiser, and have a second chance to keep you Blood pressure down, and let that heart muscle thin out so it can fill better during diastole, and actually pump more blood to those kidneys...
