I agree with this. Who's to say you didn't have a pneumonia initially and went home and developed heart failure as a complication? If X-rays show pneumonia initially, case closed.

You can sue anyone, to win. You'll have to prove there was a duty to act, the doctor failed act, that there was actual damages and the failure to act was the proximal cause of the damages or something along those lines.

My other advice get a good life term policy so you don't leave your wife with nothing when you die instead of trying to sue doctors that are attempting to help you.

So what's the permanent damage from the delayed diagnosis, which needs to be proved for a successful malpractice case? Your kidneys? The defense attorney will argue that your creatinine is a little elevated due to dehydration from the new medication of Lasix, in addition to the ace inhibitor that you were recently started on.

As my cardeologist has told me, we will have to wait and see what the term "full recovery" means in my case. I was Right on dearh's doirstep by the time I got my surgery and my major organs had shut down.
Everything has already come back up to normal except my kidneys. They've got better but are still not normal. This is causing me to have issues with fluid retention. I'm on lasics (I've lost 55 lbs since surgery from shedding 7+ Gallons of fluids). But I'm still dealing with fluid issues. For example I'm scheduled to go Friday to the hospital and have fluid drained from around one lung and will turn around Monday and have the same procedure done for the other lung.

I my case, I only looked into it because my insurance company was indicating that they wouldn't pay my bill, which was almost half a mil. They ended up covering it though.

The main reasons I want to sue:
1. Thee is no valid reason they could not figure out I had congestive heart failure.
2. I'd like to maybe keep them from doing this to the next guy.
3. They came close to killing me. In fact, had I just listened to them, I'd have died around the middle of November at the latest.
