He also told them where he cleaned in the garage and how they cleaned it. Would have been pretty impossible to guess.

I don't know. This one has me scratching my head. I agree that his interrogation should have been inadmissible but it's hard to believe he didn't have something to do with it - even if it was just the clean up part.

ETA - the clean up part was explained in an earlier post.

Worded it wrong.

Mom said she saw Brendan helping clean up the garage with Avery. Thought it was just normal chores or something.

Brendan never saw blood or realized there was blood.


Again, the uncle totally did it and I think he killed her in the garage, hid it well, and the cops framed him to make sure he went away. I think they used a mentally retarded kid as part of that plan and fricked him over in the process.

If Brendan had a competent attorney with him from the first minute the cops showed up, there is a 0% chance he is in jail right now.

i still have a hard time believing that rag tag crew could sanitize any space after the type of incident that was alleged.

that would likely be my take too. i dont know that they ever put a story forward that made a ton of sense (and what they used at the two trials wasnt the same was it?)

Yeah maybe in the yard outside or something and the rain washed it away.

There is just no way Brendan should be in jail right now. That story was so bullshite and he changed it 100 times and they proved that they suggested to him what to say and he just repeated it...on camera.

And the lack of physical evidence...

And the whole "mentally retarded" thing...

And the whole "minor without attorney or guardian" thing...

They found bones in the yard and in the quarry. It happened in one of those two places I think. No one could ever really explain how her bones got so far away.

I watched the doc and was sick to my stomach. I realize the doc is biased. That's fine. But the things that were brought up certainly would have given me a reasonable doubt in the context presented.

Having said that there is no defense for the actions of the sheriff's department, the DA or the incompetent defense lawyer (in Dassey's case). Those interrogations with Dassay, the DA's commentary and the defense lawyer's commentary make it hard to say Dassay got a fair shake. And in criminal cases everyone should get exactly that.

Another thing that got me was Kratz said in his closing argument that they stabbed her multiple times and slit her throat in the trailer while chained to the bed yet there was zero blood. Those two nimwits would have trouble cleaning up a spilt soda much less removing human blood. I mean anybody with a functional brain should be able to tell that simply did not happen.

Minors generally must be told they can have a parent or lawyer present, but the decision is still left up to the minor. It isn't all that different from Miranda.

In fact, the Supreme Court (5-4 decision) only recently held that a person's minor status should be part of the calculus in determining when an interrogation even requires Miranda warnings.

So, minors are slightly more protected in when they have to be informed of their rights, but they are still entirely free to waive them and incriminate themselves.
