First degree also includes murder when in the commission of another felony like armed robbery or kidnapping.

The max sentence for attempted first degree murder is 50 years.

Assuming there's no forensic evidence, try to shake the victim's identification of the defendant. Come up with a witness claiming he was somewhere else. Make the prosecution prove its case. The defense doesn't have to prove he's innocent, just provide reasonable doubt. If the prosecution does a shitty job, who knows what might happen.
And hell, maybe this is the wrong guy. Being a TPOS doesn't necessarily mean he's the TPOS who did this particular crime. Ideally, that's for the legal process to sort out, although it doesn't always turn out that way.

It took a minute but I was able to decipher his post from 2 days ago. He's thankful for his mom being there when dad wasn't.

Depends on what the law defines as premeditation. Doesn't necessarily mean careful planning. He made a conscious decision to try to kill the medical student. Not sure what Louisiana says on that, but you could make a case for premeditation even with that short time frame.

La doesn't require premeditation as an element. 2nd degree murder is you just straight up kill a guy. Don't like his face, he insulted you, whatever...2nd degree is mandatory life in prison.
1st degree is murder + something else. Murder + you were committing an armed robbery or other serious crime; murder + victim was under 12 yrs old; murder + victim was over 65. 1st degree carries life in prison or death penalty.
Since this guy tried to kill someone while committing a serious crime (kidnapping and armed robbery) it will be attempt first.
