I'm no lawyering type but in my line of work, there was a court case that the company using the "estimate" line lost because the estimate has to be reasonable. Meaning, they say it's 4 weeks out but it's just an estimate, but they can't take 4 years, because that's not reasonable based on the 4 weeks estimation.

I would AMEX their arse and order from somewhere else. I have three HVAC distributors within walking distances of my office so maybe I am just lucky that we are able to get parts and units as quickly as we do.

Just call and cancel the order. There should be no trouble considering your unit has probably not even been built yet.

Did you order from a distributor or the manufacturer? Is this a reputable company?

Ask for an expedited schedule.

Remind them it would be a pity to lose your business and that you intend to notify your credit card company for non-delivery of goods after payment if your goods don't arrive in a short amount of time.

I would be as nice as possible while saying that. If they don't give you an updated delivery period, cancel the order. If they say no, call AMEX.

I can't imagine anyone living in the South having to wait that long on air conditioning parts. There's a million HVAC companies around here. Call another one!

They can't take your money and then not deliver the goods you bought. That's theft and no matter what they say about the time frame "being flexible," that isn't enough to negate the fact that they fricking stole your money.

I took the "be nice" advice. Called the company and politely the time frame was unreasonable and requested expedited service. They told me, "read the terms".

I then said it doesn't have to go the route of me calling AMEX to charge it back and asked, politely, for them to reconsider. She said, "do what you have to do".

So I called AMEX. They totally understood and are charging back the money AND get this, AMEX has had 3 such calls in the past 6 months about this company which often results dropping a company. I was surprised the rep even told me that.

Awesome. And based on the way the count at the business was responding I'm not surprised Amex has multiple complaints. That company sounds like they're headed for some legal troubles (criminal as well as civil). They're running a Ponzi, ripping off/stalling new customers and using that money to fill old orders etc.

Yeah, that's exactly what it sounds like to me as well. That company is likely circling the drain on its way down and robbing Peter to pay Paul. They are probably on credit hold and can't get anything out.

Call the manufacturer of the units and see if this guy is a legit dealer for them. IF he is, they should rectify the situation.
