That's how a lot of houston has started doing it. I asked when we first bought our house here. They said something about its the neighbors fence. you take care of the portions that face you, and your neighbors do the same.

??? The "nice" side of the fence should face outwards. If you don't like seeing the boards in your own yard, put up more fence boards on the inside. Nothing worse looking than a neighborhood where the shitty side of the fence is showing in everyone's yard. Only time that is acceptable is if you are against the woods where no one will see, or there's a drainage ditch/right of way that no one is going to really see regularly.

The 2x6 toe board will lengthen the life of the pickets. It will take the abuse of lawnmowers and weed eaters. My fence has 2x12 toe boards.

PTM, can you finish the inside completely if you care to pay for that? It would look the same to your neighbor but your side would have the same look all the way. Not that it looks terrible.
As I said, be firm. Also, point it out NOW. The longer you let him go the more he is likely to have to fix. As far as the one 4 x 4 already warping/twisting, make him replace it. If it going to be part of your gate it will be trouble.

Personally I like it this way as well. I grew up with it this way and I always consider it more important as to how people see your house over how see it from only the backyard. It's almost never done this way anymore.

I had a fence built at a prior home where we chose the shadow box design on the portion visible from the street and the side shared by a neighbor. We put the ugly side facing outward on the backside where there was no neighbor.

I would highly recommend that you stain the fence so that it will last longer. Did they use nails or screws? Screws are the way to go.

I don't know why people don't put up "shadow box" wooden fences. It looks much better than that crap and uses about the same amount of fence boards. Its win, win for both sides.
But if I had an HOA that required that I'd move or never bought.
Just hang boards on your side and be done with it. Make them change the crooked corner post but the others will be hidden. Plant shrubs in front of it.
