If you drive drunk, all on you.

If you get too intoxicated to consent to sex, the liability lies on the aggressor, male or female. And what if the aggressor is also intoxicated, with no recollection?

Does the distinction come from intent?

I am truly curious. It is such a gray area. You choose to drink, drive drunk, get pulled over and arrested, your bad choices (or worse, kill someone). You get wasted and get raped, the liability shifts, even if the rapist was drunk. This isn't me giving my opinion, merely looking for feedback on a very difficult subject.

Caveat. Voluntary intoxication as a defense is limited to specific intent crimes like murder

If a person is raped, while voluntarily intoxicated, it doesn't count?

You are stating the defense. My point, what about the offense? Two very different views, depending on the offense v. defense.
