$2 Junk Shop Photo Turns out to be 5 Million Dollar Billy the Kid Pic

Previously, the only known photo of Billy the Kid...

How could you be certain that the person in the picture is Billy the kid?

Article says that the pic was taken in the summer of 1878, but there aren't any leaves on the trees?
