On flat ground, no, neither a four wheeler nor a side by side are easy to flip. But since they're often driven on uneven terrain (ditches, ruts, etc) flipping is a very common occurrence. My 10 year old cousin suffered severe permanent brain damage in a four wheeler accident several years ago and it seems like I hear another story like this every week. Those machines are MUCH too heavy and dangerous to be driven for fun by a kid. The only time a child should ever be on one is if an adult is driving and it's just for transportation, not for a joyride. It doesn't take a genius to see what a machine with that size and power can do to a kid if it rolls on them

The comments about the driver being the kid's godfather and the ones saying it was a side-by-side with more than one seat are under the article on WAFB's Facebook page.
It seems unclear if the kid was riding in an actual seat or if he was in the back cargo area.

That is what it sounded like from the initial info, which doesn't help the driver's case at all.
There are a lot of types of side by sides. The sportier models all have seatbelts. This one sounded like it might have been a polaris set up for hunting. If he was in that type of model and he was show boating around with a 12 yr old just sitting in the small bed in the back unrestrained (obviously because those models aren't made to carry passengers there)
that would be gross negligence. (in that scenario)

Driving donuts in the sand with an unrestrained child in the bed of a Polaris Ranger is gross negligence..... easily.

Man I hate these kinds of stories. Both of these families lives are ruined. I have always hated the idea of kids and atvs.

Have to agree with the previous poster...if no drugs or alcohol were involved and this guy was doing donuts and throwing sand with an unrestrained kid then it is still gross negligence...he is a grown man and was showing his arse instead of being responsible adult and taking responsibility for the safety of a child. Adults have to think about the possible dangers and not allow these situations to happen if at all possible. This was so easily preventable

I have THREE friends that have lost children to ATV accidents in the last five years. That's sufficiently statistically sobering to me to keep my kids off of them.

I own this exact model, the thing has a 1000cc\85hp engine and does 72 mph. Its really easy to turn over if you're driving recklessly. The thing weighs 1300 pounds stock so its not like turning over a little 90cc 3 wheeler. Go back 20 years and the biggest 4 wheeler was a 400cc. Many ATV's and UTV's have 1000cc and larger engines now which in turn make them much more dangerous to drunk, unexperienced and underaged drivers...
