Benson could have done ANYTHING -- prior to putting the teams into an irrevocable trust. Once he did that, she could tell him that once he died and she got control of the team that she was going to eat out Helena Moreno on the 50 yard line of the Falcons games, and that if he didn't like it he could F*CK OFF.

His only recourse at that point would be to have the trust declared null (need some damn good legal reasons for that) or replace the teams in the trust with assets of the same value -- which he doesn't have. An unsecured promissory note might work in some cases - but only in a situation where the grantor has MORE THAN ENOUGH assets to satisfy the note, i.e., let's say he had another $20 billion in cash and readily tradeable securities lying around.


Just remember the word IRREVOCABLE. Once he put the teams in an IRREVOCABLE trust he gave Rita the right to tell him to GO F*CK HIMSELF. And, apparently, that's exactly what she did.

If Gayle is putting ideas in Tom's head, why wouldn't she have done that in 2012 when the trust was formed? Was she bitching and screaming then? I have no idea.

As best I can tell from reading The Picayune these past 3 days, there are 2 separate issues re future ownership of the Saints: one being Benson's incompetency, which most legal experts are saying will be difficult to prove; the bar is set pretty high in his favor. But the other issue is the irrevocable trust that ownership of the Saints/Pels, auto dealerships, etc was placed in. According to 2 major articles, this favors Rita, as the trust administrator has to agree on any asset substitions and he has already declined the initial Benson proposal to swap ownership assets for a promisary note of $4M or so. He can replace the trust administrator, but I have not read anything about how that process works/doabilty. As usual, all the attys will be basically printing their own money & it will be a win win for those on both sides.

I am not a trust lawyer, but I've had to deal with irrevocable trusts during litigation in the past. Things are not as absolute as you seem to suggest.

My guess is we have a little of both. Is Rita a raging count who no one in the front office can get along with? Probably so.

Is Tom off his rocker? One could probably argue he has been for some time now.

Is Gayle behind all this pushing the buttons so she can take control. Possibly. Is it warranted because Rita and her brother are getting impatient? Who knows.

Moral of the story, don't plan your future based on the promises of anyone and you won't get butt hurt in the end.

But isn't there a difference between receiving the benefits from a trust and controlling the assets therein? Not sure.

I'm not sure about that. I was under the impression that there was a separate trust involving Benson's Texas holdings. I could be wrong, though.
