Actually surgery or not, it probably wouldn't have mattered. He wasn't playing this season. The Saints wanted a reason to have him sit out the year and lay low while his domestic case plays out.
With this injury it gives them a reason to IR him and eat the money for one season. He comes back next year and everyone brushes off this incident. Galette didn't want to sit out which bothered the Saints especially when they're trying to weed out the bad apples in the locker room. Then the "F Sean" video came out, probably the final straw. Which is enough to "tip off" another incident which they knew about two years now.
