I've said from the beginning I simply do not see any verifiable impact. Everyone else is inferring impact. Its just not verifiable on the video.

He's saying that there was no H&R...that's just not true. And not all fender benders result in damage.

eyewitnesses aren't fool proof or anything, but this scenario he's saying happened seems like it would've taken a good bit longer than it seems like the eyewitness says he saw. now apparently the wife was involved with "defusing" the situation.

this is a fricked up situation that both parties escalated.

I think if he did hit the Hummer (and the video appears to show that he did) then it certainly was possible to have hit it so lightly that none of them even realized that it happened. There are still way too many details to come out with this story.

this lawyer is saying the H2 is a "military-type vehicle" and that the Hummer stopped for no reason when the video shows that there were cars in front of it.

Have you talked to all eyewitnesses? Have you asked them a variety of questions?

You aren't the police. Eyewitness accounts are extremely unreliable, and the only thing you are relying on is one guy in the background saying something in a youtube video.

In the Michael Jones case, there were literally dozens of eye witness accounts directly after the incident that were complete hogwash.

Key word: Appears. The impact is not visible on camera. Everyone is simply inferring it.

so Will's wife was out of the car, by the drivers side and was shot first. twice.

then Will was shot 8 times.

this changes everything.

That would probably be significantly more impactful than a random person in a youtube video that may not have even been there.

We know she was. The facts will come out in police interviews, depositions and cross examination.

Any reasonable person can conclude based on the movement of the 2 vehicles that there was contact. Also, so Hayes just pulled over and then got enraged that Smith left the scene because he wasn't hit?
