It works like this:

Marvel is not allowed to use the word mutant or even mention the existence of mutants.

Fox can not mention or refer to anying involving the Avengers.

It's the Marvel Studios that can't say "mutants", of which all the movies in the Avengers line (Iron Man, Hulk, etc) as well as the television show are a part. I believe it only covers live action, cartoons are a separate contract.

Proper names like that are probably the very first thing covered. As Magneto is a prominent character in the X movie franchise, there's no way it would be allowed. The 3 studios have to act like the characters used by the other studios exist.

My guess on Wanda and Pietro is that were probably considered 2nd or 3rd tier characters and thus not specifically covered (especially since they have vast history with both the X and Avengers histories). What this probably means is a totally different way of presenting them (both visually and personality) in the Avengers franchise as opposed to the X franchise.

It will be like in the early 80s when Never Say Never Again with Connery as Bond and Octopussy with Roger Moore as Bond both came out in the same year except Quicksilver won't be the main character.

marvel is 100% NOT able to this. Fox holds those rights. there was an article out there saying what mutants will now be called in the marvel U. they will be called the "inhumans."

they cannot reference magneto or any other x-men character or property. Fox has them by the balls on this one unfortunately. they will be wanda and pietro in powers and character but different back story.

Yep and it ultimately sucks we won't ever see a Wolverine or a Spiderman as part of the Avengers.

Disney Marvel and Sony Marvel have no rights to mutant. Fox Marvel has no rights to Avengers

i mean you realize they arent really though? its Disney Marvel (because they bought marvel).

There's Sony who owns some of the rights to Marvel's characters (spidey). they can do whatever they want to these characters. Marvel has no input whatsoever with Sony.
Same goes with "Fox Marvel"
