The 5th Circuit is awful if they did this. The purpose of the appeal was to challenge the fundamental fairness of the arbitration proceeding. You cannot do this without the TRO, as otherwise Zeke will have served his 6-game suspension and the issue will be moot.

Dumb question, but how are courts so quick to respond/resolve these issues all the time? Seems like they are presented with the case and then rule on it 2 days later.

There is nothing to argue, the NFLPA gave up this in the CBA. Brady case proved it.

The NFL will win this easily on appeal. They just have to show where the NFLPA collectively bargained the rules, Goodell followed the rules bargained and done, just exactly like in the Brady case.

It bugs me being a Cowboy fan, but the NFL has this one won already.

There is precedent for this in labor law, in NFL, and just no way around it.

It amazes me how so many on this site get all crazy about the NFL rulings, but fail to look at their own employee handbooks. The NFL does nothing really different than 90% of companies, school districts, etc. It is just more publicized.

I have just checked the Eastern District and Fifth Circuit PACER websites for the underlying case and the appeal.

At 12:30 p.m. on 09/11/17
The NFL filed an appeal to the 5th Circuit.
The NFL asked the original judge--Judge Mazzant--to stay the preliminary injunction, which is the order that stopped the suspension.
Judge Mazzant has not ruled on that request.
The NFL has not asked the 5th Circuit for a stay of the preliminary injunction yet, but that is possible if Mazzant denies it.

Eh it doesn't make the 5th Circuit necessarily awful if they did this, the NFL wants this resolved and dismissed ASAP so it isn't tied up in litigation throughout the season into next year. 5th Circuit grants the appeal, only available court Zeke can attempt to use is SCOTUS and, knowing that majority conservatives comprise it, he'll likely be denied certiorari bc 5th Circuit appeal renders the case moot like you stated.

this is ignorant. Zeke is going to serve that suspension sooner or later. The CBA is blatantly clear. If Goodell wants him to serve that suspension, he's going to serve that suspension.
