Secondly, because similar tampering seems to be done by pretty near every NFL quarterback. Thirdly, because if tampering took place then the punishment should be appropriate (a fine).
These 2 have nothing to do with whether tampering took place.

come on man

you're passing by the point that tampering wasn't shown and then ignoring the fact that enforcement of the alleged tampering is being carried out irregularly and vindictively

I already said based on a preponderance standard that it was shown.

I can't speak to the irregularity part, but what is the motivation to be vindictive?

You're ignoring a key portion of the due process.

And for all the "Brady is bluffing" people

quote:

NFL Network reports the sides were "moving close" to a settlement that would have reduced Tom Brady's suspension to one game, but that the league refused to "seal" the records. For its part, the NFLPA called the report "rubbish." In a searing and vitriolic statement Tuesday afternoon, the players association also officially announced it would be appealing Brady's suspension to federal court.

he is writing for his audience, not a judge

Except without a judge who is paid by the NFL to find what they want found

I haven't fully educated myself on it, but I think the nflpa, for some reason, agreed to the commissioner being initial judge and hearing appeals in the CBA.

fwiw, it wouldn't matter because the nfl already filed. But I think they would have appealed regardless.

But this time Brady and his attorneys will get to state their case in front of someone not named Roger Goodell and in front of someone who did not pay $5 million to write a report that was meant to reach a pre-determined conclusion.

wonder how much money Brady is spending on his lawyers fighting this vs how much money he is missing from 4 games... probably pretty even at this point.

I'll take the Nobel laureate's opinion over yours or the NFL's. We're talking about an organization with a "truth is fuzzy" culture when it comes to science (as evidenced by who they put in charge of their head injury studies and how hard they fought to defend that idiocy).

The irregularly it obvious given the statements of other quarterbacks. The vindictive part is to intimidate other players and organizations into believing they stand no chance of fighting a judgment.

We're dealing with a stupid culture at the top of the NFL right now. They have no idea what they are doing with their player behavior policies and are just swinging in the breeze of social media judgments that stay relevant only as long as a twitter post.

That's fine. I choose not to overlook the text message and cell records evidence, combined with the psi testing. I think Brady will have an uphill legal battle.

You're right. But the punishment for this or similar tampering crimes has always been a $20,000 fine. I posted a link to a story in this thread about the chargers in 2012 intentionally withholding footballs from the NFL that were found to have been tampered with by using a sticky substance... and they were fined $20,000. That's what I was specifically addressing.

The NFL also determined that the phone Brady used prior to the one he destroyed on or near March 6 had never been destroyed. In fact, it was made available to investigators.

Huh? Someone translate for me, please. That's either a poorly worded paragraph or my reading comprehension is down from where it should be.
