This is pretty fricking stupid. If you get a haircut from your barber the transaction is completed once the haircut is finished and you he has been paid. The key is that he would have already been paid by you.

Obviously some of you are taking this way too serious. I'm just playing devil's advocate. Obviously you have never heard of freedom of press. In the case of the websites that track stats I guess the argument can be made that if the website is making a profit directly from this then the could be liable for damages. Not sure.

Lets be serious dude. In a sue happy America, you don't think that a decent lawyer can't make a legitimate argument that people are profiting off the players without them being compensated? I would assume in this situations ESPN, CBS, Fox and NBC would be in the clear being that they already pay the NFL for usage, Draftkings on the other hand is a different story unless they are owned by a parent company that already has an agreement. I'm going to consult an attorney friend of mine on this.

A lawyer is going to do what he's paid to do, make an argument. Its legitimacy would be determined by whether they win the case or not, which I don't see how they could.

Players don't own statistics, which is simply information (not intellectual property). and have no means of monetizing stats if there were no fantasy football.

Finally someone that I can have a smart discussion with. I think the lawyer could argue that the statistics should be interrputed as a player collective tangible property. Also, if a site is using the stats as a means of profit then they could be liable.

So does CNBC have to pay all of the companies that they report financial information for? They may but I'm not aware that that happens.
