A lawyer is going to do what he's paid to do, make an argument. Its legitimacy would be determined by whether they win the case or not, which I don't see how they could.
Players don't own statistics, which is simply information (not intellectual property). and have no means of monetizing stats if there were no fantasy football.

So does CNBC have to pay all of the companies that they report financial information for? They may but I'm not aware that that happens.
