chances are you won't be offered a package with that little time with company so you won't have to worry about negotiating

This is what I'm thinking.

I think you have overvalued your worth.

The conversation at best might go something like, "we're sorry Indulger, but we're going to have to let you go. You're paid through the end of the week. Your final check will be mailed to you. Good luck".

If you attempted to negotiate that with me, I'd sympathize with you that you're losing your job, and tell you I'm sorry but that's what we're offering. If you didn't accept your severance and continued to negotiate it, I'd be damn tempted to just pay you for your last day on accounts of being a dumbass.

buying a box of cheerios is not in the same ballpark as to getting laid off. HR is expecting some portion of the group to negotiate and the guy does hav ea gripe - I moved here for this job and you lay me off? WTF?

They'll offer something just to keep people from going to court

read your employee manual. every company that I have worked for had a set severance package included in that. Typically two months pay plus an additional month for each year of work.

To be honest, I have not seen a "younger" person laid off from our company yet :fingerscrossed:. It really has been those with inflated salaries that get the axe, or non skilled laborers. There has been some shuffling of job titles and probably pay decreases in some areas. But not any flat out layoffs. Even with the operators I work with, it's been mostly older contractors or people who had other issues in the first place.

As far as negotiating....what's the worst that can happen. I mean don't go in there and push them to the point that they pull everything. But it can't hurt. It is a funny situation though, because you've got no leverage. "I need this much severance, or I'm not letting you lay me off". If that works, let me know.

At any company I have worked for where an employee did not have an Employee Agreement/Contract and it was a Right to Work state then the employee had to take it or leave it.

Companies in Right to Work states do not have to offer any severance or reason for firing if a contract isn't in place.

That is my understanding.
