Pipeline Right of Way and Servitude agreements

Do any of you know the what landowners are currently getting for price per rod in Southwest Louisiana for proposed pipeline construction? All of the recent agreements that I have researched at the Calcasieu Parish Courthouse only show "$100.00 and other valuable consideration."

Pretty much all right of way agreements, oil leases and batture leases, only memorandums are filed at clerks offices. The memorandum has the parties, legal description and general terms of lease. They usually leave out the exact payment schedule.

A lot of variables. Could be very lucrative, especially if you can form a consortium with your neighbors.

Usually depends on the diameter of the pipe. Talk to your neighbors or better yet find a local attorney that has done row deals in the area.

The diameter of the pipe is 24" and the pipe is to be buried 36". It is earmarked for the Sasol NA expansion. The proposed route is not expected to be surveyed until next week and the land agent emphasized that the route is only proposed at this time.

I located the owner of the contiguous property but he has been unavailable to date. Just curious. Thanks.

Good luck. Wait until the survey is done and you know how many linear feet they need before you go dial up an attorney. Odds are the company has a price per foot in mind, you just have to find out how to get as close to that as possible. If you're unreasonable they will either reroute or threaten to condemn you. Also make sure you discuss tax consequences with a knowledgeable lawyer or CPA before signing anything.

The cost are all over the place depending on the width of the easement which depends on the size and operating pressure of the line. Another consideration is if the pipeline company needs to use your property beyond their easement say for access purposes.

It can be from $250 to $650 or higher. Remember it is all negotiable.

Another consideration is if they will destroy anything marketable like crops or trees. Often they will put this in the per rod price.

Thank you very much for your guidance. The link was very informative. Yesterday my tax prepared told me that Louisiana is an eminent domain state but the product in the pipeline may not qualify it for being a common carrier. He did give me a name of a client from Sulphur who has numerous pipeline agreements and will be forthcoming.

Just for what its worth, my cousin signed the agreement for a pipeline ROW and Servitude near Sulphur, LA for a ten-year term with renewable options based on the cost of living index. The easement is defined as the width of the pipe and a thirty foot of temporary work space was granted. The diameter of the line is 8 inches and the service was ethylene. The length of he pipeline is about 47 rods and the price was $1125 per rod. There are over twenty owners (all cousins) with undivided interests in the tract but it is better than a sharp stick in the eye.

It was negotiable as you said. Thank you very much.
