Unglesby and the fractured vertebrae

Did anybody listen to Unglesby on 104.5? He said(paraphrasing) that he wasn't sure that the guy with the fractures didn't have them BEFORE he met up with the LSU players. Something about having a pretty rambunctious night before that.
If I've got my stories straight, hadn't the consensus been the driver of the truck got the fractures, not Lowery? And there hasn't been any info on that guy other than he was just pulled out and beat?

Yep, guy with the messed up face is Lowery ... he does NOT have the fractures..
Good .. I hope that they pull medical records. But if he lies about who his doctors are, how do they get them???

Unglesby is a well known defense attorney in BR. Has a nice big house on highland rd. Likes to take the high profile cases. He is currently defending the person who murdered a boy in St Francisville and recently defended greg harris in the chiquita tate murder trial this summer. The guy is a good lawyer.

In a criminal case the defendant has a 6th Amendment right to use the compulsory process (get the court to issue a subpoena) to direct persons to testify or bring in documents (for example medical records) that may aid in their defense. Additionally, the State has the responsibility to turn over to the defendant all evidence which is materially exculpatory (tends to show innocence) or can affect punishment. Thus, if the state has medical records in this case which can demonstrate the fractured vertebrae were from a lingering injury or occurred apart from the fight, it gets to the defendant.

It depends on the type of fracture and we still don't know what type of vertebral fracture that he has. Many times the CT or MRI scans will show edema around the fractures indicating that the fractures are acute. If no edema (swelling), many radiologists will read them as chronic. However, with the history of the recent injury the radiologist could assume that the fractures came from the incident per the history given to him.
It's hard to say, but the defense could call a medical expert to say if he thought the fractures were acute or chronic. However, if they happened the night before...that wouldn't exactly help. At this point it doesn't really matter. I believe that Lowery and company probably deserved what they got, but the bottom line is that you can't beat someone senseless when they are one the ground...doesn't matter if they "started" it.

Probably one of the best defense attorney in BR. The DA is hating that Jefferson has hired him. Lewis won't plead it down. Lewis will fight it all the way to the state Supreme Ct.
If he wins, he will also turn around and sue the hell out of someone.
Lewis is tough as nails.
