Justifiable Homicide in Louisiana makes no mention of the weapon used and how it was obtained, assuming a weapon was used at all. If the firearm was obtained illegally and possessed illegally then that's a separate charge he would face. Unless he's a convicted felon or the firearm was stolen, there's no reason to think that the firearm would have been possessed illegally anyway.

People need to get this shite out of their head that most firearms are illegal or the possession of firearms are illegal or that most people that possess firearms are possessing them illegally. That's an extremely small percentage of people holding firearms at any given moment. This mentality feeds into the "guns = bad" agenda.


I 100% agree with what you said.

Louisiana has “stand your ground” laws plus you can have a hand gun on your person as long as you are 18 or older (open carry) plus your car is an extension of your home and you can have a gun (pistol/long gun) at the age of 18 or older in your car. So the only worry for me, was the gun illigal? If the gun is his or a family members then he should be fine because everything I have read so far points to self defense.

I teach law studies and an entire unit of gun laws and safety in the state of Louisiana plus I have my conceal carry license.

I pray everything will work out and I’m just glad he is ok and wasn’t hurt.

I will take that advice man, thanks. I’m not sure why that one guy was questioning Clyde having a gun on him. That’s a completely normal thing, as long as he possessed it legally.

I got bit by a dog one time and called the police. I was just riding my bike. The officer asked me if I had a gun. I said not a hand gun. I said that I don't have a permit. He told me that it is better to get caught with a gun than get caught without one if I needed it. Obviously he goes in places where not having a gun could be dangerous. I don't have an issue with him being armed. That is not exactly a safe area. As a matter of fact, there are many unsafe areas where we live.

I've bought and sold plenty of items on craigslist (without carrying a gun to any of them). You guys are in here calling everyone a pussy but you're afraid to sell something to someone you met on the internet?

Meeting at night (UPDATE: I thought this happened last night but after looking at the story, it was during the day) in an area that has a high crime rate was an extremely dumb idea. I don't know what happened, but I know it wasn't anything good. Hopefully, CEH is on the right side of the law and his life isn't ruined trying to make a few hundred bucks. Either way, that's a tough experience to go through.

Seriously, where the frick do you folks get this shite?

If you're not a juvenile, there is no "illegal" possession of an otherwise legal firearm in Louisiana. The 21-year thing is a Federal requirement for purchase and you need to be (I think) 21 for a concealed permit.

Assuming a handgun, as long as it isn't stolen or has an obliterated serial number, and the shoot was justified, whoever pulled the trigger won't spend the night in jail, IMHO.

Probably won't be any need for a cover-up. The fact that his dad is a cop tells me that CEH probably has a better understanding of the justifiable homicide statute than most.
I invite all to read the statute: R.S. 14:20
From what the circumstances sound like currently, CEH will claim self defense under subsection (A)(4)(a). And because CEH was legally inside a motor vehicle and the departed had illegally entered that vehicle, CEH will benefit from subsection (B) providing a legal presumption that he had the requisite fear of loss of life or great bodily harm.
