So the owner admits it?
Serious question: how are there not rules against this?
Server: Today's special is a flame-grilled cheeseburger with lettuce, tomato, and pickles. That is served with a side of fries. And that is going to be $16.
Customer: I'll have that.
Server: Certainly, excellent choice. One of the chef's specials.
Walks across the street to Burger King, throws everything on a plate
Server: Enjoy your meal. I should also note that a 20% gratituity is automatically added to your bill.

A LOT of restaurants use pre-made food, but using another restaurant's product is taking it too far.
Ever wonder why half the egg rolls you've ever eaten at Chinese restaurants have tasted exactly the same? They're frozen and supplied by a wholesaler in California. The chili that you get at many places is identical for the same reason.

Popeyes bought the right to Diversified Food's (Al Copeland's company that still supplied Popeyes and other Copeland's ventures w/ seasonings and food, etc) recipes in 2014 for $43 million. Id imagine their legal team is on this.
So yeah, if they are literally using Popeyes' recipes, they are acquiring them illegally and breaking the law selling the product as well.
If they made a replica recipe that closely mimics Popeyes, not sure there is anything that can be done
