Edited because newcomers are responding to something that has been addressed.

Although it wasn't necessary. Non-competes are almost always thrown out due to being a right-to-work state. They're virtually useless. And beyond that, small companies are not going to blow money/time taking a non-executive-level employee to court over such a thing.

I wouldn't bank on that. I've seen people taken to court and pushed out of their new job over this.

This is only about 100% wrong.

I'm glad people think that, though. They always just sign them.

Try to fight a well designed non-compete and let us know how it works out.

LOL so false.

had an employment offer fall apart 3 months ago because the president of the company did not want to deal with the possibility of someone coming after them and me because of my non compete. I'm not even close to an executive. Sucks because it would have been a sweet 18% per year base + bonuses raise.

Sorry. No. I have enforced non-competes through litigation many, many times on behalf of several companies. It is true that most small companies won't pay to go that route but many mid-large companies will successfully.

As for the OP, the company would likely get in more trouble legally for keeping confidential files with employment information unsecured than the employee would for robbing his file.
