It's obviously not life threatening, but who wants to have his ankle chewed on or get tripped by a yappy dog when he's out for a morning run.
Why not use your foot to sweep it away from you. Sounds like the guy didn't intend to KILL the animal, so I'd give him the benefit of the doubt.
I say the owner is to blame because she broke a law and could have prevented the whole situation.
