Something I took away from the ESPN Gurley article

I don't know all of the legalities, but I feel like if this isn't attempting to make money off of your likeness....
I wish LSU would nip that whole effort by his family in the bud before it becomes an NCAA violations mess that we're seeing now with Gurley.
quote:
A source told ESPN's Joe Schad that the NCAA investigation centers around whether Gurley was given money for autographs, memorabilia or the use of his likeness. Georgia officials did not reveal the alleged violation.

the ncaa enforces rules only on who it chooses and turns a blind eye to others

only a guess ...
there is probably a distinction between "above board" and "behind the walls"
the CLC handles most of the licensing

If Fournette and/or his family are the ones selling those shirts and pocketing the profit then LSU needs to step him and tell them to cut the shite out. If it's random people, or the university itself, and none of that money is going to Fournette or his family (At least not directly with a paper trail) then there's nothing the NCAA can do about it.

The way it was explained on the radio is Gurley was doing it through a third party who makes money to influence athletes to use a certain agent.
And if it's Buga's family that is running the show, and he's only getting "paid" from his mom like a normal kid gets money from their parents, I don'tsee it as an issue

I don't see an issue as long as it doesn't have LSU on it. The colors may be some type of issue But I don't think LSU owns the trademark to purple

Buga is not LF's likeness.
It is something that his family has called him for a very long time. There are interviews and articles which explain specifically: BUGA means "real"... as in genuine / not phony.
It does not mean Leonard.
If Leonard grew up with his family saying: "Keepin' it Real" ... or "Dude" or "Homeslice", and his family noticed that the way their son and his friends used the phrase made it trendy, I don't see any reason they shouldn't be able to capitalize on selling t-shirts, hats, etc. saying "keepin' it Real", "Dude" or "Homeslice". It is not Leonard's likeness.
So, again, since Buga means "Real", and does not mean Leonard, the same idea should hold true. This has been documented in interviews before there was any thought of trademarking the word and selling merchandise. So, it is not a backstory created after the merchandising idea was launched to artificially create separation between LF and the word BUGA. It should not be a violation.

It's ridiculous that these kids can't make money off of their names but the NCAA and universities can with jersey sales and other memorabilia

Anything to keep poor college kids participating in NCAA sports from making some money while the Universities and Coaches make millions. And that reminds me that old adulterer Charlie Roberts at the Alumni Association made 300K a yr for promoting the fans of the players.
Todd Gurley Out For Missouri - Is He out For The Season
Richt and the university should stand behind Gurley, have him plead innocent and return any pittance he received, stonewall the NCAA due to the O'Bannon ruling, and not go apeshit. Make it hard on the NCAA to be so pious and not hurt themselves and Gurley by suspending him in his last few games before he wins a Heisman and goes into the NFL. At the worst they could follow the Manziel precedent for 1/2 game suspension against a non-conference opponent and defer that until next season when he is gone and it will not hurt him. Gurley has bled for the UGA faithful and his family is poor. Very soon the SEC will be bidding for the services of athletes. Now they are used to make millions for the University and pay the millions for coaches but they are expected to risk their health and ignore their financial needs and the needs of their families. That is exploitation. The Power 5 conferences have the authority to create their own legislation to benefit athletes. Whatever Gurley got, it is still well below the current shortfall in the value of his scholarship versus his cost of attending school.
“What's fascinating is right now the conferences are all promoting we want to pay full cost of attendance, we want to give them life insurance, we want to give them graduate school assistance,” Berman said. “They're all competing, which is what we say should be happening. It should not be the case where the NCAA and its school members all sit around the room and decide what the kids get.”
BUGA and the Honey Badger: Buga does not have a likeness or an autograph and it is something the family owns. Several people made millions off of Honey Badger T-shirts outside of the University and LSU did nothing to stop them. Now Tyrann Mathieu is resurrecting the Honey Badger because it still has commercial value as a brand name and I hope he makes millions off of it for the shafting he got from LSU versus Auburn turning a blind eye to Nick Marshall who was arrested in public while driving. Marshall is also a Heisman contender and will be entering the draft as a likely first round pick in a few months.

Judge allows scholarship cases to continue vs. NCAA, conferences
Oct 9, 2014: Yesterday, A parade of 17 lawyers filed into the courtroom Thursday on behalf of the NCAA, conferences and all of the plaintiffs. There were another eight lawyers on the phone. At one point, Judge Wilken remarked that it would be a shame if the sides couldn't agree on future scheduling Thursday given how much money all of the lawyers spent to be in Oakland.
In the O'Bannon ruling on Aug. 8, Wilken stopped short of allowing athletes to receive money for endorsements. ]“Allowing student-athletes to endorse commercial products would undermine the efforts of both the NCAA and its member schools to protect against the 'commercial exploitation' of student-athletes," [/u] Wilken wrote. What a crock of crap. Allowing student athletes to make money off of commercial endorsements is in what way "exploiting them"?
Former Texas A&M star Johnny Manziel was investigated before the 2013 season when reports surfaced that he had received money for signing autographs. The NCAA reached an agreement with the school for Manziel to sit out the first half of the opening game against Rice, with no finding that the player did anything wrong.

i really hope Gurley is suspended for more than just selling autographs and memorabilia. NCAA would be way to strict in this case, IF his season is finished because he wanted to make a little money I couldn't get behind the NCAA in this situation.
