Will Mary Landrieu, and the other Senators in competitive races, be willing to give their opponents a last minute issue with which to attack?

I don't know what happened,but, Rush, Hannity and Stein all went off the air in North Ms. about 3 weeks ago. I used to listen as I drive, which I have to do a lot. No Rush anymore, it's some woman and the Finance guy, Ramsey, on all day now. I don't know her name,it's not a well know lady, like the blond that substitutes on Fox T.V. often.

The vote will not take place until after the elections. The time between the elections and the January swearing in of the new senators.
It won't be before the election since congress is not in session.

This is a technicality. They only have a "session" on October 15th for the purpose of formally adjourning until November 12th. In other words, Congress is done with its work until November 12th. No one is coming back to Washington before Election Day, short of an emergency session.

I don't think it is farfetched, the administration thinks Holder is great and would love another radical political hack clone. Maybe they nominate someone professional or vanilla, but I doubt it. In my opinion, whether the Democrats retain control of the Senate or not, the administration is about to put their agenda into 5th gear. How can they do that without loyal executive department leaders?

I never expected the Senate to take up the matter until after the election. Doing so would be the ultimate self-inflicted October Surprise for Democrats up for re-election.
If Democrats retain control of the Senate, then it is likely they will confirm whomever Obama names as a recess appointee shortly after the election. If Democrats lose control of the Senate things could get interesting. The Senators who will be losing their seats in January will have to decide whether loyalty to Obama and/or the Democrat Party is beneficial to their futures. So it's not a given that Harry Reid would have enough votes to get a recess appointee confirmed before the Republicans would take control. So it's possible that a recess appointee occupies the Attorney General position when the new Congress convenes.
Can you imagine the fun if the position becomes vacant when the new Congress convenes? The advise and consent role of a Republican controlled Senate will be quite a constraint on Obama's choice for nominee as Attorney General.
