The only thing raising age to 21 was increase the accident rate in the 21 to 23 bracket with next to no effect on 18 to 20 year olds. Useless law. Since our beloved liberals want to imitate europe, why not their drinking laws?

I have talked to several cop friends about random drunk driving checkpoints. They all said the same thing:

a. It's a waste of money but it's not the dept's money. It comes from a Fed agency and it's extra pay that cops like to get.

b. On the average night a cop will stop almost 100 drivers. The average number of drunk drivers caught is between zero and one.

So the cops feel it's okay to waste money because it's federal money? Are the cops forced to take the Federal grant to do checkpoints?

Maybe now it would, but when it was enacted during the Reagan Administration, with Elizabeth Dole as Secretary of DOT, that was the threat.
MADD was really growing in influence then.

I thinks its a matter of, this particular grant is designated for checkpoints.

If they didn't want to do the checkpoints, couldn't they just not accept the money?

One would think. IA or another state in the Midwest sued on those grounds. USSC ruled that the amount withheld was not enough to be considered punitive; therefore, upholding the law as constitutional.

Don't remember the drinking age thing I remember when they threatened to withhold federal funding unless you accepted the uniform 0.08 BAC for DUI. Some states were still at 0.12.

The cops in Shreveport have not had a pay raise in 5 years. They make extra money by doing security at concerts, check points, etc. Firemen have it worse. You cannot live on it. You gotta do construction work or lawn mowing service on the side.

So, the answer is 'no' they are not forced. They do it for the same anyone does overtime work. BTW, I think the only group who should be 'forced to work' is welfare recipients.

I don't believe in any form of welfare. I'd rather see Americans dying of starvation in the streets.

Harsh? Perhaps.

If I am not mistaken the state lowered the drinking age from 21 to 18 for a weekend in March of 96. The Feds threatened to take away highway funding so the state gave in and changed it back to 21 the next week.

Yep. They closed the 'Louisiana Loophole' in 1995. A lawsuit was filed in Avoyelles Parish, based on the clause in the state constitution banning age discrimination. The state Supreme Court agreed and struck down the 21 drinking age.

Tricky Dicky Ieyoub decided he could just enforce the law anyway, and after about a week the court stayed its ruling. The Lege prepared a constitutional amendment to make the drinking age 21, but they dropped it because the Court reversed itself after a special election replaced one of the members.

Actually it has cut down on teen drunk driving. Hasn't cut down on teen drinking, but that's considerably less dangerous.
