DO NOT DO THIS IN TX
They warned us about Texas.
Apparently Alabama is screwed up as well. They recognize our permits, but can't have it in the glove compartment, or something like that.
I will always check the laws before I go to another state.
Makes me glad that I live in LA.
And if the gun wouldn't have had a whole 2 bullets, she would have been fine. It's ok to carry if you have a permit from another state, as long as it isn't loaded

Looks like it's up to the officer. Apparently it's the fact that it was loaded, with 2 bullets (lol) is what got her

Procedures for Investigation of Conduct Involving the Possession or Transportation of Firearms
A. An officer who reasonably suspects that a person is transporting a firearm in violation of New Jersey law should make reasonable inquiries in order to confirm or dispel that suspicion.
B. In a case where circumstances reasonably indicate that the person's possession and transportation of the firearms my be permitted by 18 U.S.C.A. 926A, the officer should make reasonable inquiries in order to determine whether the person's possession is permitted by that federal law.
C. If reasonable inquiries lead an officer to conclude that the person's possession is lawful under either New Jersey law or 18 U.S.C.A. 926A, as described above in Section II, the officer should promptly allow the person to proceed.
D. Whenever an officer has probable cause to believe that a person's possession of a firearm is in violation of New Jersey law and not permitted by 18 U.S.C.A. 926A, as described above in Section II, then the officer should make an arrest.

Yet we're supposed to excuse police criminality because it's a tough job and people make mistakes
She broke the law and if she took a CC she should have known. I just want equal enforcement against pigs and I want NJ cops to abide under the same law (currently they're allowed to conceal carry)
If I were a A2 supporter in NJ with some frick you money and connections I'd start a push to make it illegal for cops to CC off duty

Isn't there a Republican governor in New Jersey who can just pardon her if she's convicted? Which I don't suspect he has the guts to do.

A responsible gun owner would have at least taken a few minutes to do a google search.

What I was thinking. Would be the right thing to do.

One would think. But...we are talking about a woman.
Yeah I said it.

so if I brought cannabis from CO into wyoming and was arrested, would you think that was bogus?
same thing if you ask me.
While I think this lady is getting railroaded, your analogy is quite correct

Is it? Cannabis is still an illegal substance as far as the federal government is concerned.
Posted on 9/16/14 at 1:07 pm to civiltiger07
Yea, I don't think it works for that reasoning.
Does NY still have that large soda ban? I think a more accurate analogy would be getting fined in NY for having a large soda in your car from out of state.
this is all silliness

We're talking about state laws here and while we're at it and you brought it up........how has the Fed exercised their legal right to prosecute the folks in Colorado for toking up? Not the way they should have BUT it is SOP for this Administration NOT to follow the law.

quote:Pretty much. The fact that he even went out of his way to deny PTI to this woman is pretty bad. I imagine that he will open up the opp to apply for PTI again.
The prosecutor has postponed the trial in order to, "review his office's position on the matter." You think he started to feel some pressure for giving Ray Rice PTI and attempting to put Allen in jail for 10 years minimum?

Yes she should of known that a CC Permit didn't apply to each state. However, do you feel that she should go to jail for anytime at all for crossing a state line? I don't

And no one any where in this process told her that her permit was only valid in the state of issue? Or to check local gun laws before traveling?
They should have. Taught me that in my CCP course.
