Judges are not beholden to the will of the people, they are beholden to what the constitution says. If there's a law from the will of the people that violates the constiution, judges have a duty to strike that law down.

In what way does gay marriage violate anyone's freedom of religion?

Nobody is forcing churches to conduct, participate in or recognize gay marriages. You are free to object to both homosexuality and gay marriage.

Marriage was not originally a religious institution. The religious have changed the definition of marriage to fit their lifestyle, which is great (I am Christian), but they are throwing a tantrum these days at the idea that not everyone latched onto their redefinition.

Irrelevant. Marriage is a right. Due process is a right. Therefore, preventing a marriage on the some basis of sex is a violation of rights. Plain and simple. Deal with it, gramps.

Friends of mine who have been together since law school, 25 years, were married up north but have always lived here. They were excited to get a great premium thru Obamacare only to find out bc LA doesn't recognize their marriage, they can't get the plan.

Another friend had been with this guy for a while from Argentina who faced deportation. Wouldn't have been a problem if they were opposite sexes. Could marry.

The Windsor case involved the death of one woman and the other woman paying taxes on the inheritance bc NY didn't recognize their marriage.

There's also SS and VA benefits, benefits like health insurance when your spouse is a state or federal employee. This couple in Texas are the fathers of twins they were denied legal status.

A lot is lost when the state does not recognize your marriage.

I notice that you didn't say anything about homosexual sex in your fairly long post. I also notice that the federal court in the Utah decision did not mention homosexual sex in its reading. Amendment 14, the amendment cited in the decision, does not mention homosexual sex. The entire Constitution, in fact, refrains from mentioning homosexual sex.

I wonder why, therefore, a few people in this debate keep shoehorning homosexual sex into this debate? Homosexual sex has literally nothing to do with the constitutionality of same sex marriage and same sex marriage bans.

This comparison will not stop until long after those who are obsessed and insecure with homosexuality and homosexual sex overcome their affliction.

Exactly and my religion accepts Gay marriage. So now your religion is more important than mine. That is what you people keep missing. Not every religion in the world has the same beliefs. In this country mine has just as much right to its beliefs as yours.
