The original article says they are "reminding" drivers to have their driver's license. Why? People shouldn't need reminders for this. This insinuates to me that they plan on asking to see everyone's driver's license.

And what's the issue if they do ask everyone to see it? It's your responsibility to have it with you anytime you operate a vehicle. Don't get mad if you get caught without something because you went through a checkpoint.

You're either a 1L in law school or a senile old man who knows everything about the law/constitution without ever having actually studied it. Hard to tell these days.

You're right. I phrased that incorrectly. My issue is with them asking to see my ID.. not with the checkpoint.

The original article says they are "reminding" drivers to have their driver's license. Why? People shouldn't need reminders for this. They want to "avoid any unnecessary delays." This insinuates to me that they plan on asking to see everyone's driver's license.

If you are one of the cars that falls into a slot to be checked you will need to provide your ID or you will be legally detained until your identity is determined. I am not a big fan of these checkpoints but MADD has pushed for them and SCOTUS has ruled in favor of them.

They are more than welcome to. And I am more than welcome to politely decline their request unless they have probable cause.

You're driving a vehicle. They have every right to know if you're licensed to operate said vehicle. Telling them no is probable cause.

You should try it, then videotape what happens.

Sorry but that won't fly at a checkpoint. You will really be digging a hole for yourself if you do this. The odds of you being stopped are low but if you are you will be required to produce ID in accordance with the law.

We do but one of us will end up in jail and one of us will not if we are both stopped at a checkpoint.

Unfortunately this socialist way of thinking/law making has invaded our great country.

Some people just know everything I guess.

I do hope you keep us up to date on how this works out for you should you ever go through a checkpoint though.

Can you link me the law about ID refusal at a checkpoint? If I'm wrong I would love to know.

You are wrong but i am not going to do the leg work for you. Do a Google search of SCOTUS rulings on the issue and look up LARS 32 signals. You should also look at cases from the 5th circuit Court of Appeals on this issue. Happy hunting.
