Clouser, then 19, was charged after a witness found her baby strapped in a child safety seat in the middle of the intersection at 45th Avenue and Cholla at 12:45 a.m. June 2, 2012, Phoenix police said.
Clouser's boyfriend and the infant's father, Manuel M. Pena, 19, was arrested early that night for driving under the influence with the child in the car, officers said. He was charged with aggravated DUI.
Officers said Clouser was upset after Pena was arrested and went to a friend's residence, where she smoked marijuana.
According to authorities, Clouser admitted to being under the influence of marijuana when she left the child on the roof of her car and drove off. She drove about 12 miles before reaching her destination and realizing the child was missing.
She was arrested after returning to where the baby was found. Police said they witnessed her driving up to the scene and detected signs of impairment when they spoke with her.

Which are misdemeanors in the state of Louisiana and carry a maximum of six months in jail. I imagine it is similar there.
Now, this is a bizarre case and I don't deal with these kind of facts often, so there could be something buried in the code, but I doubt it.

I'm shocked. Shocked, I say that this wonderful young woman was not married to the baby daddy. So, now that we realize her Hispanic boyfriend is the victim of racism, let's go with giving the baby to the Pink Haired Momma's Momma. IE, let Grandma take the baby.

Near miss accident. Nobody hurt. Terrible mistake. Forgivable? Yes. So why is everyone so prone to throwing people in jail for issues such as this? There are ways to handle incidents like this other than locking people up. Apparently the judge has more incite than you so maybe he made the right decision. Americans are so used to the idea of locking people up that they think this is the avenue for all that have screwed up. Where does it stop?

Why women are allowed to be judges and pass judgement and sentences upon the citizenry of the country when their hormones get all throne out of whack 5 days every month is beyond me.

Should be put in jail for reckless endangourment child abuse and a few others. Spend some time in some type of mental institution if she doesn't spend time in jail.

how do they know it was 12 miles? did someone see her after the 12th mile? just curious...I personally believer that of course she deserves jail time...but she probably should have lied lol
