From 2 extremely high sources in the BR/La law offices...don't admit to shit, don't say a work but "no sir" to everything.

Acting like y'all are buddy buddy with the cops won't do anything

You could get you some of those shoes with the thick soles like those crippled kids in 3rd grade wore.

Also, this thread here completely displays my discontent with DUI laws. They aren't applied the same across the state by any means. Depending on the jurisdiction, you have tons of different degrees of punishments.

It's maddening here in Michigan. The judge who tossed Jalen Rose in the slammer is the worst one you can draw in the state. And she is in a really nice suburb. Just bad luck for him. That judge throws everyone in on the first offense. On the flip side, a guy in one of the unions I represent killed someone on the west side of the state a few years ago and he got probation. There may have been some extenuating circumstances/contributory negligence things that I don't know about, but I don't think so.

What?!?! I gotta hear how this happened. Please tell.

In Ak, used to be (Not sure if the law is still the same, this was more than 10 years ago) that if you are in a vehicle with keys in your possession they could arrest you for DUI.

quote:

In order for a DUI charge to stick, prosecutors must establish that you had physical control of your vehicle. This does not mean that you have to be driving. Most judges will say that if reasonable evidence exists to show you will drive immediately after you are found by police or that you drove immediately before you were found by police, then you can be arrested for DUI.

quote:

Several factors can contribute to a judge or jury believing that you had physical control of your vehicle. Some of these factors are as follows:

You are in the driver's seat
The car is running
The keys are outside of your pocket or in the ignition
The engine is warm

They can bust you like that in LA too. I knew a guy who got drunk, decided to sleep in the passenger seat of his car in a parking lot and got a DUI.

I also know a guy who got busted who had drank nearly a case, and the cop chewed his arse up & down... and then drove him home.

It's a luck of the draw thing in a lot of aspects.

field sobriety tests...which nobody passes.

I passed one, out of my mind, standing in the mud in pouring rain.

Was with a wonderful GDI, whose beauty enabled me to chastise one of the two officers for their lewd eye movement (we were caught in the act), and somehow I pulled it off.

Believing this was Lady of Lourdes level stuff, I became a devout Catholic again that night. It only lasted for maybe six days or so, but I was pretty thankful and pretty gungho.

Yes.

ETA: I thought I would be given a blood test though. I requested one and never got it.

This is stupid.

Arresting people bc of something they MIGHT do.
