Homeowner wounds suspect during shoot-out in SW Houston
quote:
HOUSTON (KTRK) -- A shootout in Sharpstown sent at least one suspect to a hospital. Police say three men stormed the house and forced the homeowner into a closet, but that's where he gained the upper hand.
Inside a home on Braeburn Valley near Beechnut, a high stakes drama played out. Police got a 911 call from the owner who said three men had broken into his house.
HPD Sgt. J. Brandon said, "They confronted the homeowner, assaulted him briefly and they put him in a closet."
They didn't look in the closet, because that's where he keeps his guns. Police were told the homeowner thought the men had left after a few minutes. He went downstairs, armed just in case.
quote:
"I saw the burglar lying on the concrete and there was already somebody standing over him, just a random driver," Gaddis said. "It looked like he had blood coming out of his neck and his leg. He was saying something -- turn me over, it hurts, move me."

"Guess what? The owner had a gun," Gaddis said. "He did exactly what he was supposed to do -- with the gun, that's what they're made for -- protect his home."

"If my neighbor was getting robbed and they’re coming out of his front door, stuff in their hands, I’ll pull and ask them to ‘Stop, freeze, don’t move,’" Gaddis said. "And if they keep running, I’m gonna shoot ‘em too."
This would not be a justifiable shooting, right? I know if a person is being attack, "self-defense" can be provide by a third party, but do castle laws only apply to the resident?

Can't keep up with "what kind of suit do I wear" or "my girlfriend might be cheating on me" I guess.

I work at a hospital down the road from there. Didn't hear about it. Interesting.

Actually, it is perfectly legal to use deadly force to protect your property in Texas (nothing to do with Castle Doctrine). You can also protect someone else's property as well, BUT, YOU MUST HAVE ADVANCE AUTHORIZATION TO DO SO.
Usually, the owner will say after-the-fact "heck yeah I gave my neighbor Joe authorization to protect my stuff...don't remember exactly when, but I know darn good well I did." (wink-wink). This is how Joe Horn got off the hook.
To be on the safe side, my neighbors use this… LINK

Stop being lazy and drag their dead arse back in your neighbor's house. C'mon man.

Thanks for the info.
I wonder how that works in Louisiana? I live next door to a family member (single female) so I wonder if something like this would be necessary for me to protect her home and property? It's ashame most attornies are assholes otherwise I may have more of them as friends that could help with this kind of stuff. Instead, I'm left with the OB.

Probably not. Like most every other state, I suspect that Louisiana only allows use of deadly force for protection of life.

Yeah, if you shoot someone, they better be in your house or breaking into your car while you're in it.
We need a stand your ground law though.
