If your employer pays you less than the federal mileage rate, do you

just claim the remainder on your taxes? Does an employee have the ability to go tell their employer to pay them the full $.566 per mile?

If he/she is not a pussy. That doesn't mean they have to pay it though. You can claim the difference on your taxes.

Only if you have enough Form 2106 mileage expenses to exceed the 2% misc deductions threshold on your Schedule A and then only if your total Schedule A deductions exceed the standard deduction for your filing status.
