Sounds like the casino had a faulty machine and this guy took advantage of it.

If an ATM is faulty and you knowingly keep taking money out should you get to walk away with the money ?

No joke man. How's that argument going to go in court? But your honor, they won nearly a million dollars off of this machine. That's not supposed to happen. EVER!

If a casino fails to inspect an automated shuffle machine at the BJ table and it results in BJ every 4th hand, should you keep the money?

That is the only machine that ever pays out for me at casinos.

Completely different situation though.

Actually I think there are laws regarding what odds they can tune the machine to, the casino's argument may revolve around this, but I don't see how it will hold up since their negligence allowed it to keep occurring.

With all the appearance of a high-roller, complete with entourage, Nestor was able to persuade a casino staffer to enable the double-up feature on an IGT Draw Poker machine in the Meadows’ “high limit” room. A supervisor immediately reversed the decision, and the staffer went through the procedure to turn off the feature again, but neglected to save the change.

Damn. Supervisor could have changed his mind. Who knows, right? Presumably all the high limit plays before the decision was "immediately" reversed were legitimate, so it's sort of hard to call the other high limit plays illegitimate.

ATM isn't a game of chance with specific rules designed for the game. Not a valid analogy. He followed the rules allowed for this game. They just happened to have poorly designed the game.

agree, in fact things like this used to happen a lot before they went digital. the running joke was the "guy with the screwdriver" never showed up when you were losing.

but there used to be glitches galore when they paid out coins.

had he done something like stolen or wrongfully acquired proprietary information that gave him the advantage or used some sort of magnet or electric device to trick the machine, then he would be guilty. As it stands, it is a massive gray area unlike the ATM analogy.

re: Two men arrested for hacking a video poker machine and winning $1 million

I had found a slot machine one time that had to be broken. Paid out way too much way too often. This was at Casino Rouge right before they became Hollywood. I would go once a week put in 40 dollars and it was rare that I didnt cash out within 30 min for 400+ Won 1000+ 2x on it in a month. Felt like they were watching me at one point. Sometimes I would literally walk in put in a 20 and walk out 5 min later like it was an ATM. When they switched to Hollywood they must have done something to it as the machine stopped hitting and I stopped going to that casino. It was so bad I showed my boss one time the slot I was talking about and we each put in 20 and cashed out 800 to split min later.

Either insane luck or I had found an ultra loose slot I figured.

Was it a certain bet you had to play to keep hitting on that slot? I don't gamble much and when I do its not on the slots. I can't imagine the slot paid out like that for everybody.

nope it was the machine, in fact it stayed that way with several machines when they first switched over the hollywood.

that's why it was good to look at the machine number on the side of the machine because they moved them.

I even had one that just slowly spit out dollars for about an hour at intervals of about 10 minutes and the person had walked away. An attendant saw me walking around and watching the machine and he finally told me to bucket them because they weren't aloud to touch them.

Isle of Capri in Shreveport was the same way one certain machine in the back always paid off. My mom went once a month and never left without winning $1000+.

That all changed when it was bought out and name changed.

My guess is that you are knowingly taking advantage of a fault in the video poker machine's logic.

Doing it once or twice? Sheer luck.

Realizing that it's a bug and continuing to take advantage of it is the problem according to the law for these two.

Exactly, I see no difference between this and the guy awhile back who accidentally put his $300 phone on ebay for $30 and had it sell immediately. It was obviously a mistake, but it you play the game you have to honor your frick-ups.

This is an imperfect analogy as well. He found a fault in the software, innocently it appears, then devised a scheme to exploit it on a grand scale. That goes a little farther than your analogy. I'm still not sure I would consider it criminal though, but it is a gray area to me.

re: Two men arrested for hacking a video poker machine and winning $1 million

Just a 3 wheel dollar slot. Played 2 dollar bet which was max. It could have just been set to be a loose slot. But jesus that damn machine was insane. If I could buy it when Hollywood eventually goes under I would. I figure I cashed out probably around 8k off of it in only a few months. There was no system. Just show up put money in and collect. Now on a couple of occasions I did lose but it was rare. Never played with more than 100 at a time was the rule I kept and only went 1 time a week. Never had an IRS amount win either. 1000 was the most I had it hit.
