I worked in a paper mill for a year and read about this case. The EPA wanted to call rain water runoff from timber lands industrial waste. Basically, the environmentalist made up there own law and ran with it. The fact that lower courts agreed on this is embarrassing. Common sense should have prevailed somewhere before the Supreme Court.

On my phone. I just read your post. The last time I researched this was when a claim was being brought against loggers for run off concerns. The EPA didn't make a ruling yet and the industry didn't know what was going to happen.

Apparently so. But your summary represents the tree view.
The forest view... is one of the EPA extending the CWA and CAA far beyond it's legislative design. For example naming CO2 as a pollutant for the purpose of regulating it. This case has the potential to greatly limit such expansions. That is why it was adjudicated. And that is why it indeed is a bitch slap IMV. YMMV.

I entirely disagree. If anything, this ruling gave the EPA more power to interpret its own regulations. Look for them to exercise that discretion the other way in different cases.
