Animals can't give consent legally because of the current legal definition of consent in many states, not all. When did we start applying human standards of legality to animals? Yes and yes. Incest would simply have to be consensual. Beastiality would simply have to be consented to by the aninals owner.

The thing I don't get is the following: if there is some freak out there that has sex with his pets, he is deluded enough to do it whether it is illegal or not. So the question comes to you think that people should be prosecuted for that. I suppose it would probably fall under cruelty to animals for most libertarians so it's a non issue.

Libertarian doesn't mean no laws at all Just limit those laws as much as possible and focus on protection of property and civil liberties.
