Agreed. As some have said, I think he knew exactly what he was doing and chose to do it anyway. As a result, he will have to deal with the consequences of his choice.

I think you're misunderstanding "temporary insanity". You can't just kill someone because you're really mad and then claim no culpability because you're mad. He walked to the house for a reason, to grab his gun. He walked back to the wreck for a reason, to shoot the driver. He also hid the gun for a reason, because he knew he should not have killed the driver.

He almost certainly knew what he was doing and was in his right mind when he did it, as evidenced by his hiding of the gun.

I'd have killed the POS drunk driver as slowly and with as much pain as possible. I'd have no problem with going to prison or even being put on death row. But first I would make sure there was the reckoning of him dying by my hand and in his last moments knowing why his death had come and why it was so terrible.

Again, I don't think he's exempt either. But I also don't think this crime is worthy of a life sentence, which is what I assume the prosecution would be going after.

eta: shit, this is Texas. The man DEFINITELY doesn't deserve the death penalty.

And this is what it all boils down to, and is the reason why the dad is going to jail
