Since the dog is being observed, I take it that the owners did not have shot records? Is that the case?

Otherwise:
1. It's not your fault. If your daughter was invited over and the parent was aware, then it is her responsibility to properly supervise. The owner failed to do so.

2. Request the owner to pay for your medical bills not covered by your insurance.

2a. If owner refuses, file a claim against their homeowner's insurance policy. If a renter, file against the property owner's policy.

2b. If owner does own the house and they do NOT have homeowner insurance, you're just screwed.

3. Any decent homeowner will happily make an insurance claim for your incident. But if the dog owner is going to be a prick/bitch instead of doing the right thing, then see if you can get a lawyer who will pursue the insurance company on contingency and go for pain & suffering...will be a hell of a lot more than medical bills.

Also I meant to add that I hope your baby girl heals up real quick, both physically and emotionally. I'm raising two granddaughters here, age 10 and 12. Had em since they were both in diapers. If this happened to either of them...

Lots of times on homeowner policies, animal liability is excluded and you buy back X amount of liability coverage for animal liability. Hopefully she has something on her policy.

i guess times have changed. my favorite dog i ever had was a german shephard named "bullet". one day bullet bit one of my friends that was sleeping over. it was a pretty bad bite if you know what i mean. my dad immediately got his 12 gauge and killed bullet.

Yeah, my terrier would be dead within 12 seconds of me making sure the victim was ok.

If my dog bit a child the childs father wouldn't have a chance to shoot it. But my dogs are raised better than that.

I know it a little different but I remember having a few roosters and chickens back in the day and the neighbor said one attacked his kid and my dad went out and shot them all (roosters) right then.

Same here, if my hound or BMC bit someone that wasn't breaking in my house, they wouldn't have to quarantine them....

I just thought about what Id have to do if my pup did that to a little girl, and it would be tough, but Id have to put him down too. it would suck.

Did the parents notify the 9 year old little girl to not go by the chained dog hiding under the car? I just dont see how the insurance company doesn't pay out on this case.

to be honest,this really isn't even a blip on my give a shite radar at the moment. I have good insurance.

Oh I agree that the insurance company will pay out, but it without having all the facts, it would probably be a crap shoot in court.

Like MJ said though, this shouldn't be the concern right now.

Your insurance is not their fricking business. You pay for your insurance. You can recoup 100% of what your insurance is paying out and you bet your arse you'll be out of pocket yourself on some medical bills. I know priority is your kid but don't let them get away with this shite.

And she had permission to be on the property. The insurance will pay out. And he has a case if he were to sue.
