The engagement ring is a promise to marry. No marriage, purchaser of the ring should get the ring, regardless of the circumstance.

If their is marriage, each keeps their ring. If she cheats on you on your honeymoon, you shouldn't have married a whore. If he doubles up with your sister and a coke whore from the bourbon street, stop dating douche bags.

Fiancee' is a lawyer. She's worked on case like this before. Like one poster said, the ring is a promise or agreement to get married. If the woman calls it off, she is required, by law, to return the ring. The proposal is basically a verbal contract.

I'd give the ring back if the engagement was broken or divorced within first 2 years of marriage(irreconciliable differences) .
If he cheated during engagement or after we wed even if its in the first 2 years, im going to pawn it and start anew

Before I asked my soon to be ex to leave the premises, I got that ring back. I had just upgraded the original ring, only a couple years ago. No frickin way she should keep it.

Now, how much of the appraised value of the ring should I expect to get back when I sell it?

This may be true in the jurisdiction where your fiancee is admitted to practice. However, in the vast majority of jurisdictions in the U.S., the analysis is different. The ring is treated as a gift, but the gift is conditional rather than complete. Classic example of a conditional gift: I'm going off to work in NYC, and you can have my car unless I get fired the first year and move back to Hicksville. The gift is made, but is subject to the completion of some condition. This is different from a contract, where each party provides consideration to the other. Courts in most states generally don't like to view the engagement as a contract involving the payment of valuable property (as a matter of policy). So they go the conditional gift route. The ring is a gift, subject to the condition that the marriage occurs. If not, the gift isn't complete and the giver is entitled to the ring back. A subtle distinction perhaps, but different rules come into play with contract breaches than with conditional gifts.

There's consideration, intent, and delivery involved, so I think if the marriage hasn't ocurred, the ring should go back. The gift is conditional on a marriage, isn't it?

I'm not a lawyer, but I think this is a conditional gift. Is it conditional on the acceptance of the proposal or the actual marriage?

I think the ring should be returned to the person who bought it or owned it before.

The whole thing about giving a woman a diamond ring to get married is a whole lot of bs. Its crap.

I am married now, and I did give my wife a diamond. But if she died (I don't see us gettiing a divorce), and I remarried, I would say frick the ring. Besides it being a waste of money, you are basically buying her off. Who wants a slave? Ok, well, a lot of you but not me.
