No, he's not, and this is not the first time an Attorney General has chosen to not defend a Federal statute.

Why would I be? Can you even read? Holder made a clear distinction between defending a statute in court and enforcing it... as did I in this thread.

So you would Not have an objection to a president deciding separation of church and state is unconstitutional and refuses to defend a statute disallowing mandatory prayer in school?

I certainly would have an objection, and I'd criticize him to no end. But my objection would be to his smarts and to his interpretation, not to the legality of his refusal to insincerely argue for a statute. He can't legally refuse to ENFORCE the statute.
