re: 2nd Ole Miss student sentenced in noose on statue... - tuptiger
You're a simple man. We get it. The idea that this should not be construed as a threat is laughable. Do you think the little count did it for any other reason than to offend/threaten black people? Maybe his dad should be punished.
He's a 20 year old college frat star. ...

re: 2nd Ole Miss student sentenced in noose on statue... - tuptiger
The only way they get away with this charge is because of "willful intimidation". Placing a noose on a statue, in my opinion, isn't "intimidating" all black people. The issue is whether or not black people felt "intimidated" and what would reasonably rise to the level of "intimidation". I...
So if you don't say anything just point to someone and do a throat slit motion while holding a noose, is that a threat?
We're really not talking about "threats" per say. We're talking about someone's perception of fear. I don't think a throat slashing motion with a noose in han...
So it has to be a verbal threat? Holding an item used to execute people isn't enough? What about the noose and throat slitting motion?
If we're still talking about the perception of force, I think a verbal threat with a noose in hand is sufficient grounds to justify the charge ...

re: 2nd Ole Miss student sentenced in noose on statue... - tuptiger
So if they walked up a black student and held a noose in their face, is that a threat?
Firstly, a noose is not like a gun. Secondly, it would depend on whether or not the person said he was going to lynch the person he held the noose in front of. ...
So let's assume this statute should exist. What should be standard for deciding what is threatening?
An actual threat If he put on note on the statue saying he was planning to lynch a black person, ok. ...

2nd Ole Miss student sentenced in noose on statue... - tuptiger
[link=(http://www.wtok.com/content/news/2nd-former-Ole-Miss-student-sentenced-for-statue-vandalism-387869792.html)]LINK[/link] I don't get this. Why is it a crime to place a noose around a statue? They didn't actually damage the statue. ...
